Agence France-Presse (hereafter AFP) is the publisher of this platform for the online display of a regularly updated news service produced by AFP (the "News Content") and press releases and corporate communications issued by companies and institutions (the "PR Content"), intended for the general public, accessible at: us.afpnews.com (the "Platform"). The News Content and the PR Content are together referred to as the “Content”.
- “you”, “your”, “they”, “their”, “user(s)” shall refer to any user of the Platform;
- “AFP”, “we”, “our”, “us” shall refer to Agence France-Presse and, when applicable, AFP’s licensors and the issuers of PR Content.
- Scope of these terms and conditions of use
These terms and conditions of use (the "T&C") apply to your use of the Platform and its Content.
- Ownership of the Platform and its Content
The Platform, all its components, and the Content (whatever its form and nature: news stories, press releases, photos, videos, text, still and animated graphics, trademarks, logos, etc.) available on the Platform, are the exclusive property of AFP, its licensors and the issuers of the press releases and other corporate communications made available on the Platform and are protected by intellectual property laws.
You are only authorized to use the Platform and the Content as expressly set out herein.
You are authorized to view and share extracts of the Content and/or the Platform for strictly personal, private and non-commercial purposes only.
Any other use of the Platform and/or the Content, in whole or in part, in particular (by way of example and without limitation) any reproduction, communication to the public or distribution of the Platform and/or the Content, any modification, translation, decompilation, extraction of the Platform and/or the Content, any systematic or automated data collection activities (such as scraping, data mining, data extraction or data harvesting) carried thereon, for any purposes than those expressly authorized in these T&C, are strictly prohibited.
You hereby warrant and represent that you will use the Platform, its features and the Content in strict compliance with these T&C and the applicable laws and regulations. You hereby undertake to defend, indemnify and hold harmless AFP (and, where applicable, AFP’s licensors and the issuers of the PR Content), from and against all expenses (including attorneys’ fees and litigation expenses), costs, losses, disbursements, damages, liabilities, arising out of or in connection with any claim, demand, action, proceeding, directly or indirectly resulting from or based on a breach by you of this warranty.
Limitation and disclaimers on liability
The PR Content available on the Platform is displayed as provided to AFP by and under the sole responsibility of the issuer of such PR Content (who is identified within each piece of PR Content) and is in no way controlled or overseen by AFP. Consequently, AFP cannot guarantee that the PR Content available on the Platform is accurate, complete, adequate or compliant with applicable laws and regulations and AFP shall in no event be held liable in this respect.
The News Content is provided as direct news copy from AFP’s real-time newswires. As such, the information within the normal context of a newswire comprises contemporaneous news coverage that by the nature of developing events may contain errors including sequence, completeness, accuracy and/or reliability. AFP makes its best efforts to provide accurate and reliable information but makes no warranty as to the sequence, completeness, accuracy and/or reliability of the material in the News Content and shall not be held liable for any delays, inaccuracies, errors or omissions therefrom.
You shall be responsible for making your own verification and assessment of the Content and shall be solely responsible for the consequences of any decision made or transaction carried out on the basis of any Content available on the Platform. If you notice any Content is inaccurate or contrary to applicable laws or regulations, you must report it to AFP so that such Content may, if appropriate, be corrected by AFP, its licensors concerning the News Content, or the issuer concerning the PR Content, or removed from the Platform.
Although AFP endeavors to provide accurate and reliable Content on the Platform, errors, inaccuracies or omissions cannot be completely ruled out. The Platform, its features and the Content are provided "as is", and you use them at your own risk and under your full and sole responsibility.
Concerning the online display of the news service produced by AFP, AFP does not obtain releases, licenses, right clearances or consents from whatever subjects, individuals, groups or entities contained in its photographs, graphics and videos or quoted in its texts, which may be protected by proprietary rights, copyright, neighboring rights (including, without limitation, moral rights and performers’ rights), privacy rights or rights of publicity. No release, license, right clearance or consent is obtained from the owners of any trademarks or copyrighted materials (including sounds and music) whose marks and materials may be found in the AFP news service. AFP disclaims any liability in this respect.
The access to or the availability of all or part of the Platform, its features and the Content may be interrupted or slowed down for maintenance operations or for causes beyond AFP's control (in particular, and without limitation, in case of interruption, failure, malfunction, saturation of electricity networks, IT services or telecommunications networks).
AFP reserves the right to modify, suspend, interrupt or restrict the access to or the availability of all or part of the Platform, its features and the Content, at any time.
AFP cannot guarantee that the Platform, its features and the Content are provided free from errors or any breach of security due to hackings, security intrusions, bugs, viruses, malwares, etc., that may affect your hardware, software or data.
In no event shall AFP, its licensors or the issuers of the PR Content be liable for any loss, any damages whatsoever (including but not limited to material, special, consequential, incidental, punitive, direct, indirect, or other similar damages) whether based on tort, contract or other legal or equitable legal grounds, arising out of or related to the access to or use of, or the impossibility to access or use the Platform, its features or the Content.
- Trademarks and logos
The names, trademarks and logos appearing on the Platform are the exclusive property of the issuers of the PR Content, AFP and its licensors (except as set out in section 5 of these T&C). They may not be used, in whole or in part, without the prior express authorization of their owners and in strict compliance with their graphic charter.
- Applicable law and jurisdiction
These T&C and any dispute arising thereof shall be governed by and construed in accordance with the laws of the District of Columbia.
The Courts of Washington DC (US) shall have exclusive jurisdiction notwithstanding any actions in warranty or plurality of defendants.
- Severability If one or more provisions of these T&C are held to be invalid, illegal or unenforceable under any applicable law or rule, or declared invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision of these T&C, which shall remain in full force and effect.
